About these terms
These terms apply when you use Phrazl, on this website and in the product. In them, "we", "us" and "our" mean Kaleido Ltd, a company registered in England and Wales, company number 17516332, whose registered office is at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, and "you" means you, the person using it. By creating an account or using Phrazl, you agree to them.
Phrazl is for your own private use. These terms do not affect your legal rights as a consumer, which they set out below.
What Phrazl is
Phrazl is the product described on this website. We keep improving it, so its features may change. We will not take away a part of it you have paid for without telling you first.
Your account
You must be at least 18 to create an account. Give us accurate details and keep them up to date, keep your sign-in details safe, and tell us straight away if you think someone else has used your account. You are responsible for what is done under your account.
Plans and payment
Phrazl offers these plans:
- Free preview: free of charge
- Trip pack: £6.99 once
- Full bundle: £16.99 once
The price you pay is the one shown when you confirm a purchase. Prices include any VAT or other tax due. Payments are taken by Stripe. We never see or store your full card number.
One-off purchases
A one-off purchase is paid for once and never renews.
Your right to change your mind
If you are a consumer, the law gives you 14 days to change your mind about something you buy from us online.
A subscription or other service. The 14 days run from the day you buy it. If you cancel in that time we refund what you paid. If you asked for the service to start straight away, we may keep a fair amount for the days you had it before you told us.
Digital content you buy once, such as a pack you can download or use straight away. You have 14 days from the purchase, but the right ends once you start to download or use it, and only if you agreed to that and accepted that you would lose the right when you bought it. Until then you have the full 14 days.
To change your mind, write to support@phrazl.com and say what you bought. We refund you within 14 days of hearing from you, to the way you paid.
If something is not right
The law says that digital content and services we supply must be as described, fit for purpose and of satisfactory quality, and that a service must be provided with reasonable care and skill. If something is not, you are entitled to have it put right, or to some or all of your money back. Citizens Advice can tell you more about these rights. Nothing in these terms takes any of them away.
If digital content we supply damages a device or other digital content of yours because we did not use reasonable care and skill, we will repair the damage or pay you compensation.
Using it fairly
When you use Phrazl, you must not:
- break the law, or help anyone else to
- put anything into it that you do not have the right to use, or that infringes anyone's rights
- upload anything harmful, such as a virus or other malicious code
- try to get into any part of it, or anyone's data, that you are not allowed to reach
- overload, disrupt or interfere with it, or with anyone else's use of it
- use it to harass, threaten or abuse anyone, or to send messages people have not asked for
- copy, take apart or reverse engineer it, except as far as the law allows
We may suspend or close an account that breaks these rules. Where we can, we will tell you first and give you the chance to put it right.
What you put in, and what is ours
You keep ownership of what you put into Phrazl. You let us store, copy and process it only as needed to provide Phrazl to you. You are responsible for having the right to put it there. Phrazl, this website and everything in them that is not yours belong to us or the people we license them from. You may use Phrazl as these terms allow, and in no other way.
Your personal data
How we handle personal data is explained in our privacy policy, the services that help us provide Phrazl and our cookie statement.
Ending
You can stop using Phrazl at any time and delete your account from Settings in Phrazl.
We may stop providing Phrazl. If we do, we will tell you before it stops and refund any amount you have paid for a period you will not receive. We may suspend or close your account straight away if you seriously or repeatedly break these terms.
Our responsibility to you
We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. Loss or damage is foreseeable if it is obvious that it will happen, or if both of us knew it might happen when you agreed to these terms. We are not responsible for loss or damage that is not foreseeable.
Phrazl is for your own private use. We are not responsible to you for any loss of profit, loss of business, business interruption or loss of business opportunity.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breaking your legal rights as a consumer, or for anything else the law does not allow us to limit or exclude.
Changes to these terms
We may change these terms, for example when the law or Phrazl changes. When they change, the date at the foot of this page changes with them. If a change matters to you, we will tell you before it takes effect, by email if you have an account. If you do not accept it, you can cancel before it does, and we will refund any amount you have paid for a period after that.
The law that applies
These terms are governed by the law of England and Wales, and you can bring legal proceedings in the courts of England and Wales. If you live in Scotland you can also bring them in the Scottish courts, and if you live in Northern Ireland in the courts of Northern Ireland.
